1. Acceptance of Terms

By accessing our website or hiring us for tree service or land-management work, you ("Customer," "you," or "your") agree to these Terms of Service ("Terms"). If you disagree with any part of these Terms, do not use the website or request our services.

These Terms apply to all customers, website visitors, and anyone interacting with Smith Works Tree Service and Land Management ("Smith Works," "we," "us," "our").

2. Services Provided

Smith Works provides professional tree care and land-management services, including:

  • Tree removal (all species & sizes)
  • Tree trimming & pruning
  • Stump grinding & excavation
  • Land clearing, brush clearing & debris removal
  • Forestry mulching & grading
  • Tree planting
  • Emergency services (24/7)
  • Select outsourced plant-health-care services, where licensed partners perform regulated work

Services may vary depending on equipment availability, weather conditions, safety considerations, and legal requirements.

All work is performed by trained personnel. We are insured with $2M liability coverage and carry workers' compensation for full-time employees.

3. Estimates, Quotes & Scheduling

3.1 Estimates

We provide written or verbal estimates after evaluating the job site. Estimates are not binding offers and may change based on actual site conditions.

3.2 Quotes & Work Authorization

A formal quote outlines the agreed-upon scope, pricing, and job details. Work is scheduled once you approve the quote.

3.3 Deposits & Payment

Deposits may be required for certain projects and will be outlined in your quote. Final payment is due upon completion of the work unless otherwise stated.

Accepted payment methods will be communicated during scheduling.

3.4 Change Orders

If site conditions differ from what was communicated – or if you request additional work – an updated quote may be required.

4. Customer Responsibilities

You agree to:

  • Provide safe and clear access to the work area
  • Secure pets, vehicles, and property
  • Notify neighbors if access to their property is required
  • Identify underground utilities (irrigation, septic lines, cables, etc.) unless we have agreed to handle locates
  • Obtain necessary permits unless otherwise stated in the quote

We are not liable for damage to unmarked utilities, hidden structures, or obstacles outside of our knowledge or control.

5. Service Limitations & Safety

Tree work involves inherent risks. To protect our crew and your property:

  • We may pause or reschedule work due to unsafe conditions (weather, access limitations, ground instability, etc.).
  • You must follow all on-site safety instructions.
  • You may not enter the active work zone at any time during operations.

If unsafe conditions are created by the customer, we may reschedule or cancel the job, and additional fees may apply.

6. Emergency Services

We offer 24/7 emergency response. Emergency work may require immediate stabilization, partial removals, or modified procedures to protect life and property.

Pricing for emergency services may differ from standard pricing.

7. Cleanup & Debris Removal

Cleanup is only provided if explicitly stated in the quote. When included, it covers the debris removal described in the agreed scope. Any additional cleanup, chipping, hauling, or debris processing beyond what is listed in the quote may result in additional charges.

8. Insurance, Licensing & Certifications

  • Smith Works, LLC is insured with $2,000,000 liability coverage.
  • Workers' comp is provided for full-time employees.
  • No state license is required for general tree work in Tennessee.
  • Not currently ISA-Certified, although prior certification existed.
  • Some specialized plant-health-care work is performed through licensed partners as required by TN law.

Proof of insurance is available upon request.

9. Website Use & Content

9.1 Intellectual Property

All website content – including text, images, logos, and media – is the property of Smith Works or its licensors. You may not copy, redistribute, or republish any content without written permission.

9.2 Acceptable Use

You agree not to:

  • Attempt unauthorized access to the website
  • Use the website for unlawful or harmful purposes
  • Disrupt or interfere with website functionality

10. Data Collection & Communications

10.1 Information Collected

We collect:

  • Contact form submissions (name, email, phone, address, job details)
  • Analytical data via Google Analytics 4
  • Search performance data via Google Search Console
  • Session recordings, click maps, and interaction data via Microsoft Clarity
  • Conversion and remarketing data via Google Ads
  • Call data, call recordings, and call attribution via CallTrackingMetrics, which uses Twilio as its underlying carrier

10.2 How We Use Your Information

We use collected information to:

  • Respond to inquiries
  • Provide estimates
  • Schedule jobs
  • Track marketing performance and ad effectiveness
  • Improve website performance and user experience

11. SMS / Text Messaging Communications

11.1 Opt-In Consent

By checking the SMS consent box on one of our website forms, you expressly consent to receive text messages from Smith Works, LLC regarding your service request. SMS opt-in is optional and is never required to receive an estimate or to hire us; you may instead select phone or email as your preferred method of contact.

11.2 Message Purpose

SMS communications are transactional and conversational in nature – for example, scheduling messages, quote follow-ups, appointment reminders, on-the-way notifications, and replies to your inquiry. We do not send mass marketing or promotional text campaigns.

11.3 Message Frequency, Rates & Help Keywords

Message frequency may vary. Message and data rates may apply. Reply STOP to opt out at any time, or reply HELP for help.

11.4 SMS Delivery

Outbound text messages are sent through CallTrackingMetrics using Twilio as the underlying messaging carrier.

11.5 Carrier Disclaimer

Mobile carriers (including Twilio and downstream wireless carriers) are not liable for delayed or undelivered messages.

11.6 Privacy of Mobile Information

Mobile information, phone numbers, and SMS opt-in consent are not shared with third parties or affiliates for marketing purposes. Full details are in our Privacy Policy.

11.7 Call Recording & Tracking

Inbound and outbound calls handled through our CallTrackingMetrics phone numbers may be recorded and analyzed for quality, training, lead-tracking, and service-improvement purposes. Call metadata (such as caller ID, call duration, and call routing) may also be stored. By calling us at a phone number listed on our website, you consent to such recording and tracking. Tennessee is a one-party consent state for call recording.

12. Cancellations & Rescheduling

12.1 Customer Cancellations

If you need to reschedule or cancel, notify us as soon as possible. Last-minute cancellations may incur fees if costs have already been incurred (e.g., mobilization, equipment rental).

12.2 Company Cancellations

We may cancel or reschedule due to:

  • Unsafe weather
  • Equipment failure
  • Hazardous site conditions
  • Misrepresentation of job details

We will make reasonable efforts to reschedule promptly.

13. Liability Limitations

To the fullest extent permitted by Tennessee law:

  • Our total liability is limited to the amount you paid for the work in question
  • We are not responsible for indirect or consequential damages (loss of profit, delays, etc.)

We are not responsible for damage caused by:

  • Unmarked underground utilities
  • Pre-existing tree defects (cracks, decay, rot, weak structure)
  • Weather events before, during, or after work
  • Hidden hazards we could not reasonably detect

Tree conditions can change rapidly. We do not guarantee long-term outcomes for live trees.

14. Governance & Dispute Resolution

These Terms are governed by the laws of the State of Tennessee.

Any dispute will first be addressed through good-faith communication. If unresolved, disputes may be submitted to mediation or resolved in a court of competent jurisdiction in Tennessee.

15. Updates to These Terms

We may update these Terms periodically. The most recent version will always be available on the website, with the effective date clearly displayed.

Continued use of our Services or website after updates constitutes acceptance of the new Terms.
